ANSWER:     The state of West Virginia allows your Blood Alcohol Content (BAC) to be as high as .08% before you are considered impaired based on your blood alcohol level.  You may be considered impaired due to other reasons such as other drugs in your system.  A BAC of 1.5% or higher is considered an aggravated DUI which carries greater penalties.
